These Terms of Use (“Terms”) govern your use of the Performance Age mobile app and the website at humaneering.co (together, the “Service”), provided by Hedgehog Productions LLP (a limited liability partnership registered in England & Wales, company number OC459026), trading as Humaneering (“we”, “us”). By using the Service you agree to these Terms. If you do not agree, do not use the Service.
The Service provides an educational estimate of the chronological age your cognitive and physical performance most resembles, by comparing your self-test results against published, age-normative research. It is not a medical or diagnostic test, not a medical device, and not a substitute for professional assessment. It cannot detect, screen for, or rule out any health condition. Using the Service does not create a doctor–patient relationship. If you have any concern about your memory, thinking, strength, balance or risk of falls, consult your GP or a qualified clinician.
The physical test involves physical activity — rising repeatedly from a chair and balancing on one leg. Physical activity carries inherent risks, including falls and injury. Only attempt it if you are in suitable health to do so, and if in any doubt, speak to a doctor first.
You agree to follow the safety instructions in the app: use a firm chair without arms pushed against a wall, keep clear space around you, have someone nearby if you feel at all unsteady, and stop immediately if you feel pain, dizziness, breathlessness or any other warning sign. You take part in the tests at your own risk. To the extent permitted by law, we are not responsible for any injury or loss resulting from your participation — except that nothing in these Terms excludes our liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot lawfully be excluded.
The Service is intended for adults (18+). It is not intended for, or directed at, children.
We grant you a personal, non-exclusive, non-transferable, revocable licence to use the app on devices you own or control, for your own non-commercial use. You must not copy, modify, distribute, sell, rent, reverse-engineer, or attempt to extract the source code of the app, except to the extent the law permits.
Your first measurement is free. Further tests and re-measurements require a one-time in-app unlock. All purchases are processed by Apple through the App Store; billing, refunds and cancellations are handled by Apple under the App Store terms. We do not process your payment details. Prices may change. A “Restore Purchase” option is provided.
The Service, including its software, scoring, text, design and the Humaneering brand, is owned by Hedgehog Productions LLP or its licensors and is protected by law. Photography is used under licence. All rights not expressly granted are reserved.
You agree not to use the Service unlawfully, not to interfere with or compromise its security or operation, and not to rely on it for medical decisions. We may suspend or withdraw access if you breach these Terms.
The Service is provided “as is” and “as available”. Estimates are based on population-level data and carry inherent uncertainty; we do not warrant that they are accurate for you as an individual, or that the Service will be uninterrupted or error-free. This does not affect your statutory rights as a consumer.
To the fullest extent permitted by law, we will not be liable for any indirect or consequential loss, or for any loss arising from reliance on an estimate provided by the Service. Nothing in these Terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any liability that cannot be excluded under applicable law. Your mandatory statutory rights remain unaffected.
If you download the app from the Apple App Store, these Terms are between you and us only, not Apple. Apple has no obligation to provide maintenance or support for the app and is not responsible for it or for any claims relating to it (including product-liability, legal or regulatory claims, or claims that the app fails to meet a legal or regulatory requirement). Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. You confirm you are not located in a country subject to a US Government embargo and are not on any US Government restricted-parties list.
We may change the Service or these Terms from time to time. We will update the effective date above when we do; continued use after a change means you accept the updated Terms.
These Terms are governed by the laws of England & Wales, and the courts of England & Wales will have jurisdiction, subject to any mandatory consumer-protection rights you have in your country of residence.
